This Public Offer (hereinafter referred to as "Treaty") is an official offer of the online store incade.com.ua (hereinafter referred to as "seller") and addressed to any natural or legal entity (hereinafter referred to as "Buyer") to conclude a contract of sale of goods through the online store on the following conditions.
1. General provisions 1.1. This contract is concluded between the seller and the buyer at the time of ordering at incade.com.ua. 1.2. The ordering by the buyer on the site means a complete and unconditional acceptance by the buyer of the terms of this contract. 1.3. The seller reserves the right to make changes to this contract without a prior message to the buyer. Changes enter into force upon their publication on the site.
2. The subject of the contract 2.1. The seller undertakes to transfer the goods to the buyer's property, and the buyer undertakes to pay and accept the goods under the terms of this contract. 2.2. Name, assortment, quantity, price chosen by the buyer of goods are indicated in the order of the buyer on the site.
3. The order of ordering 3.1. The order of goods is made by the buyer through the online store incade.com.ua. 3.2. The buyer is obliged to provide accurate and up -to -date information when placing an order. 3.3. Upon registration of the order, the seller confirms it by sending the relevant message to the buyer's e -mail.
4. The price of the goods and the order of payment 4.1. The price of the goods is indicated on the site in the national currency of Ukraine - hryvnia. 4.2. Payment of goods is made by the buyer in one of the ways offered on the site. 4.3. In the case of payment of the goods for non -cash payment, the obligation of the buyer on the payment of the goods is considered fulfilled from the moment of transfer of funds to the seller's account.
5. Delivery of goods 5.1. Delivery of goods is carried out throughout the territory of Ukraine, unless otherwise indicated on the site. 5.2. The cost of delivery of the goods is not included in the cost of the goods and is paid by the buyer separately, unless otherwise provided by the terms of the shares or special offers of the seller. 5.3. Delivery terms are indicated on the site and depend on the selected delivery method and the region.
6. Return and exchange of goods 6.1. Some products in our range are created under a specific order, taking into account unique characteristics. Such products are not returned. 6.2. In case of detection of technical features that differ from the stated characteristics, the possibility of exchange of goods for a similar one is provided. To do this, the buyer must contact the seller, giving photo fixation of the defect. 6.3. The cost of reverse delivery of goods for exchange is borne by the buyer. 6.4. If the goods are obtained with significant defects that make it impossible for its intended purpose, the seller makes free exchange of goods for the same.
7. Guarantee and responsibility 7.1. The seller guarantees the quality of the goods according to the characteristics specified on the site. 7.2. The seller is not responsible for the damage caused to the buyer as a result of improper use of goods purchased in the online store. 7.3. The seller is not responsible for the loss of the buyer as a result of improper filling in the registration form on the site, including for indicating false information.
8. Privacy and personal data protection 8.1. The seller undertakes not to disclose the information received from the buyer . 8.2. The seller undertakes to ensure the confidentiality of the buyer's data used only for the purpose of ordering.
9. Other conditions 9.1. The legislation of Ukraine applies to the relationship between the seller and the buyer. 9.2. In case of issues and claims by the buyer, he may contact the seller for the contacts specified on the site. 9.3. All disputes arising from the implementation of this Agreement are resolved through negotiations. In case of failure to reach consent, disputes are subject to court in accordance with the current legislation of Ukraine.
This Agreement shall enter into force on the moment of his acceptance by the buyer and acts until the parties fully fulfill their obligations.
